Dismissing the petition of the woman resident of Jhajjar, the Punjab-Haryana High Court clarified that filing a false FIR against the husband falls under the category of cruelty and on the basis that the husband becomes a divorce officer.
Filing the petition The wife said that the Jhajjar court has taken a wrong decision after accepting her husband's divorce application and it should be rejected. The petitioner said that the allegations made by her husband against the petitioner of the lower court are wrong.
Yachty never did any cruelty to her husband, rather her husband used to treat her brutally. Yachty's husband stated that he was in the Air Force and they were married in 2011. After marriage he wanted to call Yachty on his posting but Yachty's mother refused.
Even after this, the attitude of the petitioner continued to be cruel towards her and when her friends used to come to her house, she insulted him in front of them. After this, the petitioner registered cases against him and the family under various sections. In all these cases, he and his family have been acquitted.
After hearing both the sides, the High Court pronounced its verdict saying that petty quarrels go on in the husband and wife which cannot be considered cruelty. The husband had to face trial due to his wife registering an FIR and finally he was acquitted. In such a situation it falls under the cruelty of the wife and in such a case,
the trial court's decision to approve the divorce is correct.
